Please read these Terms of Service carefully before engaging San Juan Tile and Stone Renovations for any work.

By signing a project agreement, accepting a written estimate, or authorizing work to begin, you agree to be bound by these terms. These terms govern the relationship between San Juan Tile and Stone Renovations (“Contractor,” “we,” “us”) and the client (“you,” “Client”).

Acceptance of Terms

By requesting services, signing an estimate or proposal, or permitting San Juan Tile and Stone Renovations to begin work at your property, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.

These terms apply to all services provided by San Juan Tile and Stone Renovations, including but not limited to kitchen remodeling, bathroom renovations, tile installation, stone fabrication, flooring, and all related renovation work.

If you do not agree to these terms, you must notify us in writing before any work commences. Proceeding with services constitutes full acceptance.

Authority to Contract

By entering into an agreement with us, you represent that you are the legal owner of the property or have been expressly authorized by the legal owner to enter into this agreement and authorize the described work. You further represent that you are at least 18 years of age and legally capable of entering into binding contracts.

Services

San Juan Tile and Stone Renovations provides residential and commercial renovation services throughout South Orange County and surrounding areas, including but not limited to:

  • Kitchen planning, design consultation, and remodeling
  • Bathroom renovation and remodeling
  • Tile installation (ceramic, porcelain, natural stone, decorative)
  • Stone fabrication and installation (countertops, backsplashes)
  • Flooring installation and replacement
  • Custom stonework and decorative applications
  • Full interior renovation and home improvement projects

Scope of Work

The specific scope of services for each project will be defined in a written estimate or proposal provided to you prior to work commencing. Only work explicitly listed in the written proposal is included in the agreed price. Additional work requested during the project will be subject to a separate Change Order.

Subcontractors

San Juan Tile and Stone Renovations reserves the right to engage licensed subcontractors to assist in the completion of your project. All subcontractors used will be qualified professionals, and we remain responsible for the quality of their work as it relates to our agreement with you.

Estimates & Proposals

All estimates and proposals are provided in writing and are valid for 30 days from the date of issuance unless otherwise specified. Prices are subject to change after the validity period has lapsed.

Estimate Accuracy

Estimates are based on information available at the time of the site visit or consultation. Unforeseen conditions discovered during the course of work — including substandard existing materials, hidden damage, code violations, or structural issues — may result in additional costs. We will notify you of any unforeseen conditions and obtain your written approval before proceeding with work that falls outside the original estimate.

Free Consultations

Initial consultations and on-site estimates are provided at no charge within our standard service area. We reserve the right to charge a consultation fee for complex projects, extended travel, or repeat visits that do not result in a signed agreement. Any applicable consultation fee will be disclosed prior to the visit.

Proposal Acceptance

A proposal becomes a binding agreement when signed by both parties or when the client provides a deposit payment. Electronic signatures are accepted and considered legally binding.

Payment Terms

Payment schedules will be outlined in your written proposal. Standard payment structure for most projects is as follows:

  • Deposit of 33%–50% of the total project cost is due before work begins or materials are ordered
  • Progress payment(s) may be required at defined milestones as specified in your proposal
  • Final payment is due upon project completion, prior to final walkthrough sign-off

Accepted Payment Methods

We accept cash, check, Zelle, and major credit cards. A processing fee of up to 3% may be applied to credit card transactions. All checks should be made payable to San Juan Tile and Stone Renovations.

Late Payments

Payments not received within 5 business days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend work on your project until overdue balances are paid in full. Any collection costs, including reasonable attorney's fees, incurred to collect overdue amounts will be the responsibility of the Client.

Materials & Deposits

Deposits are used to secure scheduling and purchase materials. Materials purchased specifically for your project are non-refundable once ordered. Custom-fabricated materials, special-order items, and cut stone or tile are non-refundable under any circumstances.

Scheduling & Timeline

Project start dates are confirmed at the time of deposit receipt. We make every effort to begin and complete projects within agreed timelines. However, all completion dates are estimates and not guarantees.

Delays

San Juan Tile and Stone Renovations shall not be held liable for delays resulting from:

  • Acts of God, weather events, or natural disasters
  • Delays in material delivery from suppliers or manufacturers
  • Client-initiated scope changes or requests for additional work
  • Discovery of unforeseen conditions during project execution
  • Failure of the Client to provide timely access to the property
  • Client failure to make timely payments on schedule
  • Municipal permit delays or inspection scheduling

Access to Property

The Client agrees to provide our crew with reasonable access to the work area during normal working hours (typically Monday through Friday, 8:00 AM to 6:00 PM, and Saturdays by arrangement). Failure to provide timely access may result in rescheduling and additional charges.

Client Responsibilities

To ensure your project is completed efficiently and on schedule, you agree to:

  • Clear the work area of personal belongings, furniture, and valuables before work begins
  • Ensure all pets are secured away from the work area during project hours
  • Provide access to necessary utilities including water and electricity at no charge
  • Make decisions on materials, finishes, and change orders in a timely manner
  • Designate a primary point of contact who is available to respond within 24 hours
  • Notify us of any known hazardous materials (lead paint, asbestos, mold) in the work area
  • Obtain any required Homeowners Association (HOA) approvals prior to work commencing
  • Secure permits if required and not already included in your proposal

Existing Conditions

The Client is responsible for disclosing all known conditions of the property that may affect the work. We are not responsible for pre-existing defects, structural issues, water damage, or code violations that existed prior to our engagement.

Photo & Media Release

By engaging San Juan Tile and Stone Renovations, you grant us a perpetual, royalty-free, irrevocable license to photograph, video record, and document the work performed at your property — including the work area, materials used, finished results, and surrounding areas of the project — and to use such media for any lawful business and marketing purpose.

Permitted Uses

Photographs and video content captured may be used for, including but not limited to:

  • Our business website and online portfolio
  • Social media platforms including Instagram, Facebook, TikTok, YouTube, Pinterest, and Houzz
  • Google Business Profile and directory listings
  • Digital and print advertising campaigns
  • Email marketing and promotional materials
  • Press releases, case studies, and media features
  • Trade show materials and presentations
  • Client proposals and sales materials

Privacy Protections

We will make reasonable efforts to avoid capturing personally identifiable information in photographs, including visible names, faces of individuals, mail or documents, license plates, or personal items. We will not publish the full street address of any residential project without your written consent. If you do not wish your project to be photographed, you must notify us in writing before work begins.

Opt-Out

You may opt out of photography usage for marketing purposes by providing written notice to us prior to or at the time of signing your project agreement. Your opt-out will not affect your service quality or pricing in any way. Opt-out requests received after project completion cannot retroactively remove previously published content.

Testimonials & Reviews

If you provide a written or video testimonial, or leave a public review that mentions San Juan Tile and Stone Renovations, we reserve the right to reproduce, share, and feature that content in our marketing materials. We will typically attribute testimonials by first name and city only, unless you grant permission for fuller attribution.

Change Orders

Any modification to the original scope of work — including additions, deletions, or changes to materials, design, or labor — constitutes a Change Order and must be agreed upon in writing before the modified work begins.

  • All Change Orders must be submitted and approved in writing (email is acceptable)
  • Change Orders will include a revised price and any impact to the project timeline
  • Work will not begin on changed or added scope until the Change Order is signed and any required additional deposit is received
  • Verbal authorizations are not binding — all changes must be documented
  • Emergency or safety-related work may proceed with verbal authorization followed by written confirmation within 24 hours

We reserve the right to charge for additional time, materials, and overhead costs associated with scope changes, including any rework required due to client-directed design changes.

Materials & Products

Material selections, finishes, tile, stone, and fixtures will be confirmed in your written proposal or a separate materials schedule. The Client is responsible for approving all materials selections prior to ordering.

Client-Supplied Materials

If you choose to supply your own materials, San Juan Tile and Stone Renovations accepts no liability for defects, damage, or failures related to Client-supplied products. Additional labor charges may apply if Client-supplied materials are non-standard, damaged, or require special handling.

Material Availability

We will make every effort to source specified materials. In the event that selected materials are discontinued or unavailable, we will present comparable alternatives for your approval. Price adjustments may apply.

Natural Stone & Tile Variation

Natural stone products (marble, travertine, granite, slate, quartzite) exhibit natural variation in color, veining, pattern, and texture. These variations are inherent characteristics of natural materials and are not considered defects. Digital or showroom samples are representative only and may not exactly match installed materials.

Overage & Waste

Standard industry practice is to order 10%–15% overage to account for cuts, waste, and future repairs. Unused full tiles or stone may be left at the property for future repairs. Leftover partial cuts are typically disposed of unless otherwise arranged.

Warranty

San Juan Tile and Stone Renovations warrants that all labor performed will be free from material defects for a period of one (1) year from the date of project completion, subject to the conditions below.

What Is Covered

  • Workmanship and installation defects attributable to our labor
  • Grout or adhesive failures resulting from improper application
  • Tile or stone installation failures caused by our work

What Is Not Covered

  • Defects in Client-supplied or manufacturer-defective materials
  • Damage caused by improper use, cleaning, or maintenance by the Client
  • Normal wear and tear, including grout discoloration from use
  • Cracking or damage resulting from structural movement, settling, or seismic activity
  • Water damage from Client plumbing failures or flooding
  • Work performed or altered by third parties after project completion
  • Damage resulting from acts of God or environmental conditions

Manufacturer Warranties

Materials and products may carry separate manufacturer warranties. We will pass through any available manufacturer warranties to you at project completion. These warranties are governed by the manufacturer's terms and conditions.

Warranty Claims

All warranty claims must be submitted in writing within the warranty period. We will inspect the claimed defect and, if covered, perform repair or replacement at no charge. Warranty work does not extend the original warranty period.

Cancellation Policy

Cancellation by Client

You may cancel a signed project agreement subject to the following terms:

  • Cancellation more than 10 business days before the scheduled start date: Full deposit refund minus any non-refundable materials already ordered
  • Cancellation within 10 business days of scheduled start date: 50% of deposit retained to cover scheduling and preparation costs
  • Cancellation after work has commenced: Client is responsible for all work completed to date, materials purchased, and a reasonable cancellation fee
  • Custom-ordered or fabricated materials are non-refundable under any circumstances

Cancellation by Contractor

San Juan Tile and Stone Renovations reserves the right to cancel or suspend a project in the event of non-payment, unsafe working conditions, discovery of hazardous materials, or other circumstances outside our control. In the event of contractor-initiated cancellation without cause, we will refund any unearned deposits within 15 business days.

Project Suspension

If the Client requests a suspension of work for more than 14 calendar days, we reserve the right to demobilize the crew, release the project slot, and reschedule the project subject to availability. A remobilization fee may apply.

Limitation of Liability

To the fullest extent permitted by applicable law, San Juan Tile and Stone Renovations' total liability for any claim arising out of or related to services provided under these terms shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

In no event shall San Juan Tile and Stone Renovations be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to lost profits, loss of use, or costs of temporary housing or alternative accommodations arising from delays or project issues.

Pre-Existing Conditions

We are not responsible for damage to or caused by pre-existing conditions at the property, including but not limited to substandard construction, water damage, mold, pest damage, or hidden defects not disclosed to us prior to work commencing.

Insurance

San Juan Tile and Stone Renovations maintains general liability insurance and workers' compensation coverage. Proof of insurance is available upon written request. You are encouraged to notify your homeowner's insurance carrier prior to the commencement of renovation work.

Valuables

The Client is responsible for removing all valuables, fragile items, heirlooms, and irreplaceable objects from the work area and surrounding areas prior to work commencement. We are not responsible for incidental damage to items left in or near the work area.

Dispute Resolution

In the event of a dispute arising from these Terms of Service or any project agreement, both parties agree to first attempt resolution through good-faith negotiation within 15 business days of written notice of the dispute.

Mediation

If good-faith negotiation fails, both parties agree to submit the dispute to non-binding mediation with a mutually agreed mediator before pursuing any other legal remedy.

Legal Proceedings

If mediation is unsuccessful, either party may pursue available legal remedies. Any legal proceedings shall be conducted in the appropriate court of Orange County, California. The prevailing party in any legal action shall be entitled to recover reasonable attorney's fees and court costs.

Privacy

San Juan Tile and Stone Renovations collects basic personal information — including your name, address, phone number, and email address — solely for the purpose of providing renovation services, communicating about your project, and sending relevant marketing communications.

  • We do not sell or rent your personal information to third parties
  • Contact information may be used to follow up on your project or request a review
  • We may use your email address to send project updates, invoices, and occasional promotional content
  • You may opt out of marketing communications at any time by contacting us in writing
  • Property address information is used only for service delivery and may appear in our portfolio as described in Section 7

Governing Law

These Terms of Service and any project agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with any signed project proposal or estimate, constitute the entire agreement between the parties with respect to the services described, and supersede all prior discussions, representations, and understandings.

We reserve the right to update these Terms of Service at any time. Changes will be communicated in writing and will apply to new projects initiated after the effective date of the updated terms.
